JAM WORKSHOP TERMS AND CONDITIONS

Enrollment and Participation

Eligibility: Enrollment in Underhill Music School is open to individuals of all ages and skill levels. If you are enrolling a minor (under 18 years of age), you must be the minor’s parent or legal guardian and consent to these Terms and the Release on their behalf.

Class Schedules: The School reserves the right to modify class schedules, instructors, or curriculum as necessary. We will notify students or guardians of minors of any significant changes in a timely manner.

Payment Terms

Payment Authorization: By enrolling in any service offered by Underhill Music School, you authorize the School to automatically collect payment for subscriptions, one-off classes, space rentals, and any other services using the payment method on file.

Payment Methods: The School accepts various forms of payment, including credit cards, debit cards, and other electronic payment methods. You agree to provide accurate and up-to-date payment information at the time of enrollment.

One-Off Classes and Space Rentals: Payment for one-off classes and space rentals is due at the time of booking. If the payment method on file fails, the booking may be canceled.

Late Payments: In the event of a failed payment, the School reserves the right to suspend services until payment is received. A late payment fee may apply.

Refunds and Cancellations: Refunds and cancellations will be reviewed, authorized and processed on a case-by-case basis.

Assumption of Risk

Acknowledgement of Risks: I understand and acknowledge that participation in music lessons, classes, workshops, rehearsals, performances, and any related activities at Underhill Music School involves inherent risks, including but not limited to physical exertion, potential injury, and exposure to loud noises.

Health and Safety

Health Certification: I certify that I/my minor am/is in good physical condition and have no medical conditions that would prevent me/my minor from safely participating in music activities at Underhill Music School. I understand that it is my responsibility to inform the instructor of any health concerns or injuries prior to participating in any activities.

Release of Liability

Release: In consideration of being allowed to participate in music activities at Underhill Music School, I hereby release, waive, discharge, and covenant not to sue Underhill Music School, its instructors, employees, volunteers, and affiliates from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me/my minor or by any property belonging to me/my minor, whether caused by the negligence of Underhill Music School or otherwise.

Indemnification

Indemnification: I agree to indemnify and hold harmless Underhill Music School, its instructors, employees, volunteers, and affiliates from any and all liabilities, damages, costs, or expenses, including reasonable attorney fees, arising out of or related to my/my minor’s participation in music activities at Underhill Music School.

Photography and Publicity

Consent: I consent to the use of photographs, videos, or recordings of me or my minor for promotional purposes by Underhill Music School, with the requirement that Underhill Music School must obtain my prior consent, which may be communicated orally, in writing, or by any other means, before using any such materials. These materials may be used on the school's website, social media channels, marketing materials, or any other medium. I understand and agree that no compensation will be provided to me or my minor for the use of such media. I release Underhill Music School from any liability for claims or damages arising out of the use of the photographs, videos, or recordings, including but not limited to claims for defamation or invasion of privacy, provided that my prior consent has been obtained.

Emergency Decision-Making

Emergency Authorization: In the event of a medical emergency or situation requiring immediate attention regarding the participant's health and well-being, I authorize Underhill Music School, its instructors, employees, or designated representatives to make emergency decisions on my behalf or my minor’s behalf, including but not limited to seeking medical treatment from licensed healthcare professionals, administering first aid or medication as deemed necessary, and contacting emergency medical services or notifying emergency contacts listed by the participant.

Property and Equipment

Responsibility for Property: Students/guardians of minors are responsible for any damage to the School's property or equipment caused by their negligence or misconduct. The School reserves the right to seek compensation for damages.

Intellectual Property

Course Materials: All course materials, including but not limited to lesson plans, recordings, and instructional videos, are the intellectual property of Underhill Music School. Students/guardians may not reproduce, distribute, or share these materials without explicit permission from the School.

Student Work: By participating in classes, students or guardians of minors grant the school a non-exclusive license to use, reproduce, and display their work for promotional and educational purposes.

Limitation of Liability

Limitation: Underhill Music School is not liable for any injury, loss, or damage incurred while participating in any of our services. Students participate at their own risk.

Privacy and Data Protection

Data Collection: The School collects and stores personal information provided by students and guardians of minors during enrollment. This information is used solely for the purpose of providing and improving our services.

Payment Information: Payment details are securely stored and processed in compliance with relevant data protection regulations. The School does not share payment information with third parties, except as required to process payments.

Communication: By enrolling in the School, you agree to receive communications related to your enrollment, classes, and other School activities. You may opt-out of non-essential communications at any time.

Amendments and Modifications

Changes to Terms: Underhill Music School reserves the right to amend these Terms and Conditions at any time. Any changes will be communicated to students or guardians of minors and will take effect immediately upon publication.

Continuing Enrollment: Continued enrollment in the School after changes to these Terms and Conditions constitutes acceptance of the revised Terms.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the state in which Underhill Music School is located.

Severability

Severability: If any provision of this Release of Liability Form is held to be invalid, illegal, or unenforceable for any reason by a court of competent jurisdiction, the validity, legality, and enforceability of the remaining provisions shall not be affected or impaired in any way. The invalid, illegal, or unenforceable provision shall be replaced with a valid, legal, and enforceable provision that reflects the intent of the original provision to the maximum extent possible.
